Probate

Our attorneys handle the probate of Wills in the Probate Court after a person dies and we continue to assist and advise the Executor throughout the process of administration of the Estate.  If the deceased passed away without making a Will, we represent the family in the intestate administration of the Estate.  The Firm also advises trustees on the establishment and administration of trusts. K&L provides prompt and efficient client service from the petition to probate the Will , to the distribution of assets to beneficiaries, to the discharge of Executors from liability. These services often include:

  • Preparing and filing all pleadings for the probate case
  • Assisting with appointment of Executors
  • Assembling and inventorying assets
  • Arranging for appraisal or valuation of real estate and other assets
  • Notifying creditors and reviewing and resolving claims against the estate
  • Working with accountants to file estate tax and state and federal income tax returns
  • Preparing interim and final accountings
  • Transferring title of assets to the Estate and then distributing assets to the beneficiaries
  • Obtaining discharge and release from liability for the Executors

We represent many local Executors in estate matters, but we also represent Executors, beneficiaries and heirs who live in other states but who are involved with Estates in Georgia.
